Terms & Conditions

1. Acceptance of Terms

By accessing and using Flitly ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Flitly is a temporary file sharing service that allows users to upload files and share them via generated codes. Files are automatically deleted when expired or after being downloaded.

3. Acceptable Use

You agree to use Flitly only for lawful purposes. You are strictly prohibited from using the service to:

• Upload, share, or distribute illegal, harmful, or offensive content
• Share content involving minors in any inappropriate context or that violates child protection laws
• Distribute explicit, pornographic, or adult content without proper age verification
• Share politically sensitive material that could incite violence or discrimination
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Share malware, viruses, or other malicious code
• Spam or harass other users
• Attempt to gain unauthorized access to the service
• Use the service for commercial purposes without authorization

4. Content Responsibility and Liability

USER RESPONSIBILITY: You are solely responsible for all content you upload, share, or distribute through Flitly. You warrant that you have all necessary rights, permissions, and legal authority to share any content through our service.

CONTENT MONITORING: Flitly does not monitor, review, or control user content. We do not endorse, support, or assume responsibility for any content shared through our platform.

COMPLIANCE: You are solely responsible for ensuring your content complies with all applicable laws, including but not limited to:

• Child protection and safety laws (COPPA, CIPA, etc.)
• Content regulation and censorship laws
• Intellectual property and copyright laws
• Privacy and data protection regulations
• Political speech and expression regulations in your jurisdiction

INDEMNIFICATION: You agree to defend, indemnify, and hold harmless NovaCode, Flitly, and their affiliates from any claims, damages, or legal action arising from your use of the service or content you share.

5. File Limitations and Restrictions

Flitly imposes the following limitations on file uploads:

• Maximum file size: 50MB per file (2GB for Pro users)
• Maximum number of files: 20 per upload (50 for Pro users)
• File retention: Files expire automatically (15 minutes to 48 hours depending on plan)
• Certain file types may be blocked for security reasons

6. Privacy and Data Security

We take your privacy seriously. Please refer to our Privacy Policy for detailed information about how we collect, use, and protect your data.

7. Disclaimer of Warranties

Flitly is provided "as is" without any representations or warranties. We do not guarantee the service will be uninterrupted, secure, or error-free. Use of the service is at your own risk.

8. Limitation of Liability

MAXIMUM LIABILITY PROTECTION: NovaCode, Flitly, and their affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from:

• Your use or inability to use the service
• Content uploaded, shared, or distributed by users
• Any illegal, explicit, or inappropriate content shared through the platform
• Violations of child protection laws by users
• Political content or speech shared by users
• Any damages resulting from user-generated content
• Third-party actions based on content shared through our service

NO RESPONSIBILITY FOR USER CONTENT: We explicitly disclaim all responsibility for user-generated content and its consequences. Users bear full legal responsibility for their content and its compliance with applicable laws.

9. Content Ownership

You retain ownership of all files you upload to Flitly. By using the service, you grant us the right to store, process, and deliver your files as necessary to provide the service.

10. Service Modifications

We reserve the right to modify, suspend, or discontinue the service at any time without prior notice. We may also update these terms and conditions periodically.

11. Termination

We may terminate or suspend your access to the service at our discretion, without prior notice, for conduct that violates these terms or is harmful to other users or the service.

12. Governing Law

These terms shall be interpreted and governed in accordance with the laws of the jurisdiction where NovaCode operates, without regard to conflict of law provisions.
